1. Accept the Terms

1.1. Access to the Platform, as well as its effective use, implies acceptance by the User of these Terms of Use and the Privacy Policy, regardless of whether they register on the Platform. This acceptance will be ratified through the completion of your reservation on this platform, an opportunity in which the User expresses their free, express and informed consent with respect to the content of this document. If the User disagrees with any of the provisions of these Terms, they should not use the Platform.

2. Access to services and features

2.1. The Platform consists of a set of features that will make apartments available for seasonal residential rental. To this end, Hospedagem Praia Alegre SC works in the planning, maintenance and updating of its Platform, where it promotes, mediates, administers and manages seasonal real estate rentals.

2.2. The User declares to be aware that certain sections and functionalities of the Platform can only be used and accessed upon registration, at which time the User must provide all the data requested, in accordance with the provisions set out in our Privacy Policy.

2.3. In this sense, the User acknowledges that, when registering, they must provide their telephone number, to which their registration will be linked, with Hospedagem Praia Alegre SC being able to send messages to this number to validate such registration.

2.4. From now on, the User declares to be aware that Hospedagem Praia Alegre SC will use means of communication such as, but not limited to, text messages and WhatsApp messages, aiming to send information directly related to the Users' interests.

2.5. By accepting these Terms, the User declares that they are solely and exclusively responsible for all information provided when accessing the Platform, being responsible, including to third parties, for any damages or losses resulting from incorrect, incomplete or untrue information.

2.6. The User further acknowledges that the inclusion of any untrue, false or adulterated information will subject the User to all applicable sanctions in accordance with current Brazilian legislation, including criminal ones.

3. Obligations, responsibilities and exemptions of the parties

3.1. Compliance with laws and regulations

Hospedagem Praia Alegre SC respects and obeys all laws and regulations applicable to its activities and expects all its Users to do the same. However, Hospedagem Praia Alegre SC cannot guarantee and assumes no responsibility for the compliance of its Users with any laws or regulations. When using the Hospedagem Praia Alegre SC Platform or Services, the User declares to be aware, understand and agree that they are exclusively and fully responsible for complying with any and all laws, rules, regulations and legal and tax obligations that may be applied to their use of the Website, Services and Content, including, but not limited to, Federal Law No. 8245/1991, which regulates the rental of properties in Brazil, and specific rules for each condominium.

4. Reservation and use of the Property

4.1. You - as a user interested in renting a property and reserving it - allow Hospedagem Praia Alegre SC to charge your credit card, for the advertised value of the reservation, to make it effective.

4.2. You are responsible for paying any Fees you owe to Hospedagem Praia Alegre SC. The applicable Fees (including any applicable Taxes) are collected by Hospedagem Praia Alegre SC.

4.3. You accept that Hospedagem Praia Alegre SC will not be held responsible if the reservation cannot be made due to credit card limits, failure to communicate with operators or any other events that may be considered force majeure or due to the fault of third parties. Under no circumstances will Hospedagem Praia Alegre SC be held responsible due to an unsuccessful negotiation or attempted negotiation.

4.4. You understand that a confirmed reservation of a property (“Property Reservation”) is a limited license granted to you by the Hospedagem Praia Alegre SC platform to enter, occupy and use the accommodation for the duration of your stay, according to the confirmed reservation data.

4.5. You agree to leave the Accommodation no later than the checkout time specified by the Hospedagem Praia Alegre SC platform in the Listing or at another time mutually agreed between you and the Hospedagem Praia Alegre SC platform. If you stay beyond the agreed checkout period without the consent of the Hospedagem Praia Alegre SC platform, you will no longer have license to stay in the Accommodation, and Hospedagem Praia Alegre SC will have the right to request your departure in a manner consistent with applicable legislation. Furthermore, you agree to pay, if requested by Hospedagem Praia Alegre SC, for each period of 24 hours (twenty-four hours) (or any period related thereto) that you remain in an Extended Stay, an additional fee per night of up to two times the average of the Listing Fee per night originally paid by you to cover the inconvenience suffered by Hospedagem Praia Alegre SC, in addition to this amount all Fees, Taxes and any legal expenses incurred by Accommodation Praia Alegre SC to make you leave the premises. Extended Stay Fees for late checkouts on the checkout date that do not impact subsequent reservations may be limited to the additional costs incurred by Hospedagem Praia Alegre SC as a result of said Extended Stay. If you incur an Extended Stay in an Accommodation, you authorize Hospedagem Praia Alegre SC to charge you for Fees arising from this extended stay. A Security Deposit, if required by Hospedagem Praia Alegre SC, can be applied to any extended stay of a customer using the Hospedagem Praia Alegre SC platform.

4.6. Subject to meeting any requests (such as completing any verification processes) established by Hospedagem Praia Alegre SC, you may reserve a Listing available on the Hospedagem Praia Alegre SC Platform by following the respective booking process. All applicable fees, including the Listing Fee, Security Deposit (if applicable), Cleaning Fee and any applicable Taxes will be presented to you prior to booking a Listing. You agree to pay the Total Fees for any reservation requested in connection with your Praia Alegre SC Hosting Account.

4.7. Upon receipt of a booking confirmation from Hospedagem Praia Alegre SC, a legally binding contract is formed between you and Hospedagem Praia Alegre SC, subject to any additional terms and conditions of Hospedagem Praia Alegre SC that are applicable, including in particular the applicable cancellation policy and any rules and restrictions specified in the Listing. Hospedagem Praia Alegre SC will charge the Total Fees at the time of the reservation request.

4.8. If you reserve a property on behalf of additional clients, you will be required to ensure that all additional clients meet any requirements established by Hospedagem Praia Alegre SC, and agree to and are aware of the Terms and any terms and conditions, rules and restrictions established by Hospedagem Praia Alegre SC. If you make a reservation for an additional minor customer, you represent and warrant that you are legally authorized to act on behalf of said minor, in accordance with Art. 82 c/c art. 250 of Federal Law 8,069/90 (ECA).

5. Reservation Changes, Cancellations and Refunds, Resolution Center

5.1. You are responsible for any changes to the reservation made on the Hospedagem Praia Alegre SC Platform or directly at Hospedagem Praia Alegre SC customer service - “Booking Changes”, and agree to pay any additional Fees and/or Taxes related to said Booking Changes.

5.2. You can cancel a confirmed reservation at any time, in accordance with the cancellation policy defined by Hospedagem Praia Alegre SC.

5.3. If you vacate the property before the agreed deadline, the amounts already paid will not be refunded. The deadline for requesting cancellation of the reservation is 7 (seven) days, which starts from the moment the reservation is made (payment of the deposit or in full).

5.4. If the LESSEE withdraws from the lease after this period, the amounts paid will not be refunded. Rescheduling has a fee of R$100.00 (one hundred reais). This can be done with at least 15 (fifteen) days notice prior to the date of the current stay. Rescheduling can only be done once and within up to 1 (one) month following or preceding the date of the previous stay, paying the daily rate for the respective new date, according to the LESSOR's availability. In case of urgent last-minute maintenance at the property, the reservation will be rescheduled on the closest available date that follows the date of the current stay, according to the LESSOR's availability without prejudice to the LESSEE.

5.5. If Hospedagem Praia Alegre SC cancels a confirmed reservation, the customer will receive a full refund of the Total Fees for the reservation. In some instances, Hospedagem Praia Alegre SC may allow the customer to apply the refund to a new reservation, in which case Hospedagem Praia Alegre SC will credit the amount to the Customer's next reservation if the Customer so wishes. In addition, Hospedagem Praia Alegre SC may publish an automatic comment on the Listing canceled by the Host indicating that a reservation has been canceled.

6. Damage to Accommodations and damage to the Host Channel Platform

6.1. As a Guest, you are responsible for leaving the Accommodation (including any personal property or other property located in the Accommodation) in the condition it was in when you arrived there. You are responsible for your own acts and omissions and are also responsible for the acts and omissions of any individual you invite, or to whom you give access to the Accommodation.

6.2. If Hospedagem Praia Alegre SC complains and provides proof that you, as a Customer, have damaged an Accommodation or any personal or other property in the Accommodation, Hospedagem Praia Alegre SC may request payment from you through the Hospedagem Praia Alegre SC Customer Service Center. If Hospedagem Praia Alegre SC forwards a Damage Claim, you will have the opportunity to respond. If you agree to pay Hospedagem Praia Alegre SC determines, in its sole discretion, that you are responsible for a Damage Claim, Hospedagem Praia Alegre SC, via credit card, after the end of your stay, will charge any amount referred to therein from you and/or your Security Deposit (if possible) necessary to cover the Damage Claim.

6.3. Hospedagem Praia Alegre SC also reserves the right to collect payment from you and seek any remedies available to Hospedagem Praia Alegre SC in this regard in situations in which you are responsible for a Damage Claim.

6.4. If you are a Customer, you understand and agree that Hospedagem Praia Alegre SC may make a claim against your homeowner's or renter's insurance policy or other insurance policy in respect of any damage or loss that you may have caused, or for which you may have been responsible, to any personal or non-personal property (including an Accommodation) of Hospedagem Praia Alegre SC (including, without limitation, the amounts paid by Hospedagem Praia Alegre SC under the Member Guarantee of Accommodation Praia Alegre SC). You agree to cooperate with and assist Hospedagem Praia Alegre SC in good faith, and provide Hospedagem Praia Alegre SC with information as may be reasonably requested by Hospedagem Praia Alegre SC, in order to make a claim against the owner, landlord or other insurance policy, including, but not limited to, executing documents and taking such subsequent steps as Hospedagem Praia Alegre SC may reasonably request to assist in the fulfillment hereof.

7. Unpermitted Activities

7.1. You are solely responsible for complying with any and all laws, rules, regulations and tax obligations that may be applicable to your use of the Praia Alegre SC Hospedagem Platform. In accordance with your use of the Praia Alegre SC Hosting Platform, you will not, assist or enable other people to:

• violate or circumvent any applicable laws or regulations, third-party contracts, third-party rights, our policies and standards.

• use the Hospedagem Praia Alegre SC Platform or the Collective Content for any commercial purpose or for any other purposes other than those expressly authorized by these Terms or in a way that falsely suggests that Hospedagem Praia Alegre SC endorses, has a partnership with or otherwise misleads others as being your affiliation with Hospedagem Praia Alegre SC;

• copy, store or access or use any information, including personally identifiable information about any other Member, contained on the Hospedagem Praia Alegre SC Platform in any way that is inconsistent with the Hospedagem Praia Alegre SC Privacy Policy or these Terms or that otherwise violates the privacy rights of Members and third parties;

• use the Praia Alegre SC Hospedagem Platform in accordance with the distribution of unsolicited commercial messages (“spam”);

• discriminate or harass anyone based on race, national origin, religion, gender, gender identity, physical or mental disability, medical condition, marital status, age or sexual orientation, or otherwise engage in violent, harmful, abusive or disorderly behavior;

• use, display, imitate or reproduce the Hospedagem Praia Alegre SC Platform or the Collective Content, or any individual element, within the Hospedagem Praia Alegre SC Platform, the Hospedagem Praia Alegre SC name, any Hospedagem Praia Alegre SC trademark, logo or other proprietary information, or the layout and design of any page or form contained on a page on the Hospedagem Praia Alegre SC Platform, without the express written consent of Hospedagem Praia Alegre SC;

• tarnish or harm the Hospedagem Praia Alegre SC brand in any way, including through unauthorized use of the Collective Content, register and/or use Hospedagem Praia Alegre SC or derivative terms in domain names, trademarks, trademarks or other origin identifiers, or register and/or use domain names, trademarks, trademarks or other origin identifiers that closely imitate or are confusingly similar to Hospedagem Praia Alegre SC domains, trademarks, slogans, promotional campaigns or Collective Content;

• use robots, “spiders”, “crawlers”, “scrapers” or other types of automatic means or processes to access, collect data or other types of content from or interact with the Praia Alegre SC Hosting Platform for any purpose;

• ignore, remove, deactivate, harm, decode, or attempt to circumvent any technological measure that has been implemented by Hospedagem Praia Alegre SC or any of the Hospedagem Praia Alegre SC providers or any other third party to protect the Hospedagem Praia Alegre SC Platform;

• attempt to decipher, decompile, disassemble or reverse engineer any software used to provide the Praia Alegre SC Hospedagem Platform;

• carry out any action that causes harm or negatively affects, or that may cause harm or negatively affect, the performance or proper functioning of the Praia Alegre SC Hospedagem Platform;

• export, re-export, import or transfer the Application, except as authorized by Brazilian legislation.

• violate or infringe the rights of any person or cause harm to any person.

8. Copyright and ownership of the Platform

8.1. The copyright and ownership of the Platform, graphic designs and source codes are the exclusive property of Hospedagem Praia Alegre SC or third parties who have authorized their use on the Platform, and are protected by international laws and treaties, copying, reproduction, or any other type of use is prohibited, with violators subject to corresponding civil and criminal sanctions, under the terms of Laws 9,279/96, 9,609/98, 9,610/98. The brands, commercial names or logos of any kind presented through the Platform are the property of Hospedagem Praia Alegre SC or a third party that permitted their use, so that the use of the Platform does not constitute authorization for the User to cite such brands, commercial names and logos. Furthermore, the User, when posting any content on the Platform (brands, logos, names, designs, texts, images, photos, videos, phonograms, audiovisual works, source codes, etc.), grants Hospedagem Praia Alegre SC a license to use it, for an indefinite period, so that we can convey such content, in any form, in Advertisements (in physical and/or virtual media), demonstrations of use and institutional presentations. The User agrees that such content may be used on any page or field on the Platform.

9. Applicable Legislation and Jurisdiction

Penha District Court.
